Dvictus is an online marketplace and listing platform that enables users in Guyana to post products for sale, offer services, and connect with buyers, sellers, tradesmen, freelancers, and service providers across all 10 administrative regions.

By using Dvictus, you represent and warrant that:

Dvictus reserves the right to refuse service, terminate accounts, or restrict access to anyone who does not meet these eligibility requirements.

Dvictus operates on a zero-commission model:

All transactions; including payment, delivery, fulfilment, and dispute resolution; occur entirely and exclusively between the buyer and the seller. You are solely responsible for all aspects of any transaction you enter into.

To access certain features of Dvictus (including posting listings and messaging), you must create an account. When doing so, you agree to:

Each person may maintain only one account. Creating multiple accounts to circumvent restrictions, manipulate reviews, or evade enforcement actions is prohibited and may result in permanent suspension of all associated accounts.

You are solely responsible for all content you post on Dvictus, including product and service listings, descriptions, images, pricing, reviews, and messages to other users ("User Content").

Content Standards

By posting User Content, you represent and warrant that:

Content Licence

By posting User Content on Dvictus, you grant us a non-exclusive, worldwide, royalty-free, transferable licence to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Dvictus platform. This licence terminates when you delete your content or account, except where your content has been shared with others or is required for legal purposes.

Content Removal

Dvictus reserves the right to review, edit, refuse to post, or remove any User Content at any time, for any reason, without prior notice. This includes content that we determine, in our sole discretion, violates these Terms, is harmful, or is otherwise objectionable.

You agree not to engage in any of the following activities on Dvictus:

Violation of any of the above may result in immediate account suspension or permanent termination, removal of all associated content, and referral to law enforcement where appropriate.

The platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the fullest extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless Dvictus and its owners, operators, directors, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or relating to:

Dvictus is not responsible for resolving disputes between users. If a dispute arises from a transaction or interaction on the platform, the involved parties are solely responsible for resolving it directly.

Dvictus may, at its sole discretion, provide tools such as a reporting system to assist users in flagging concerns, but we are under no obligation to mediate, arbitrate, or resolve any dispute. Any decision by Dvictus regarding reported content or users is final.

We reserve the right, in our sole discretion and without prior notice, to:

Termination may occur for any reason, including but not limited to: violation of these Terms, suspected fraudulent or illegal activity, reports from other users, or extended inactivity. Upon termination, your right to use the platform ceases immediately.

You may also terminate your account at any time by contacting us. Sections of these Terms that by their nature should survive termination; including Limitation of Liability, Indemnification, and Dispute Resolution; shall continue to apply after your account is terminated.

All content on the Dvictus platform; excluding User Content; including but not limited to the Dvictus name, logo, branding, website design, layout, user interface, graphics, icons, source code, and documentation, is the exclusive property of Dvictus and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, display, create derivative works from, reverse engineer, or otherwise exploit any part of the Dvictus platform without our prior written consent.

If you believe that content on Dvictus infringes your intellectual property rights, please contact us with details of the alleged infringement, and we will review and take appropriate action.

Dvictus may contain links to third-party websites, applications, or services that are not owned, operated, or controlled by us. This includes external links in user listings (such as WhatsApp or social media links).

We do not endorse, warrant, or assume any responsibility for the content, policies, practices, or availability of any third-party services. Your interaction with third-party services is governed by their own terms and policies and is entirely at your own risk.

THE DVICTUS PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DVICTUS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Dvictus regarding your use of the platform. They supersede all prior agreements, understandings, and communications, whether written or oral.

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. We may also notify users of significant changes through the platform or by email.

Your continued use of Dvictus after any changes to these Terms constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the Co-operative Republic of Guyana, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of Dvictus shall be brought exclusively in the courts of Guyana, and you consent to the personal jurisdiction and venue of such courts.
